We at GiveIn Company, a Tennessee For-Profit Benefit Corporation, (“Company“) respect your privacy and are committed to protecting it through ongoing compliance with this GiveIn Privacy Policy (“Privacy Policy”) . This Privacy Policy describes:
- The types of information we may collect or that you may provide when you visit https://giveinapp.com (“Website”) or when you download, install, register with, access, and/or use the GiveIn mobile application (the “App“, together with the Website, the “Services”).
- Our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Privacy Policy applies only to information we collect on the Website, on the App, and in other electronic communications between you and us sent through or in connection with the Services.
This Privacy Policy DOES NOT apply to information that:
- We collect offline, such as information gathered over the phone or in person, or on any other Company apps or websites, including websites you may access through our Services.
- You provide to or is collected by any third party, including through any application or content (including advertising) that may link to or be accessible from or through the Services (see Third-Party Information Collection).
Third-party platforms or sites accessed through the Services and third parties that collect information about you or your Device through automatic information collection technologies when you use our Services (see Third-Party Information Collection) may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this Privacy Policy carefully to understand our procedures, interest and practices regarding your information and how we will treat it. If you do not agree with our Privacy Policy, do not access or use our Services. By accessing or using these Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy).
Children Under the Age of 13
The Services are not intended for children under 13 years of age, and we do not knowingly collect personal and/or personally identifiable information from children under 13. If we learn we have collected or received personal and/or personally identifiable information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, without the required consent, please contact us at support@giveinapp.com.
Age needs to be raised to 16 to comply with CCPA if you engage in cross-context behavioral advertising or selling personally information.
Information We Collect and How We Collect It
We collect information from and about users of our Services:
- Directly from you when you provide it to us.
- Automatically as you navigate through the Services. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
Information You Provide to Us
When you download, register with, or use the Services, we may ask you to provide information:
- By which you may be personally identified, such as your first and last name, email address, telephone number, physical address for billing purposes, credit or debit card number, or any other identifier by which you may be contacted online or offline (“Personal Information“).
- About your internet connection, the equipment you use to access our Services, and usage details (“Usage Data”)
This Personal Information includes:
- Information, including Personal Information, that you provide by filling in forms on our Services or by downloading, registering with, and/or using the App. This includes information provided at the time of registering to use the Services, posting material and/or requesting further services. We may also ask you for information when you report a problem with the Services.
- Records and copies of your correspondence (including email addresses and phone numbers), if you elect to contact us.
- Details of transactions you carry out after contacting us through our Services and of the fulfillment of your service requests. You may be required to provide financial information before making a donation through the Services.
- Your search queries on the Services.
You may also provide information for publication or display (hereinafter, “Posted”) on public areas of the Services (collectively, “User Content”). Your User Content is Posted and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to use, copy and/or share your User Content. Automatic Information Collection and Tracking
We, as well as our service providers and third parties, may also use technology that passively stores or collects certain inforamtion about you whenever you interact with the Services. This may include the following “Technological Data”:
- Usage Details. When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.
- Device Information. Whe may collect information about your Device, and internet connection, including the Device’s unique Device identifier, Internet Protocol address (IP address), operating system, browser type, network information, and the Device’s telephone number. Unless otherwise specified in this Privacy Policy, the term “Device” shall mean the computer, laptop, tablet, mobile phone or other handheld device, internet connected television or other devices that you use to access the Services.
- Stored Information and Files. The Services may access metadata and other information associated with other files stored on your Device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
- Location Information. The Services may collect real-time information about the location of your Device.
If you do not want us to collect this Technological Data do not access or use the Services and/or delete the App from your Device. The information we collect automatically may include Personal Information or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties.
Information Collection and Tracking Technologies
The technologies we use for automatic information collection may include but are not limited to:
- Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer or mobile device when it is used to visit the Services. It may be possible to refuse to accept cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Services.
- Web Beacons. Pages of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website and app statistics (for example, recording the popularity of certain features of the Services and verifying system and server integrity).
These tracking technologies are necessary for the Services to function and collect information for analytics – note that we do not currently personalize your experience with targeted ads or sell your Personal Information to third parties.
Third-Party Information Collection
When you use the Services or its content, certain third parties may use automatic information collection technologies to collect information about you or your Device. These third parties may include but are not necessarily limited to:
- Your mobile device manufacturer.
- Your mobile service provider.
- Google Sign-in.
- Apple Sign-in.
These third parties may use tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any Personal Information, to:
- Provide you with the Services and its contents, and any other information, products, or services that you request from us.
- Fulfill any other purpose for which you provide it.

For example, if you choose the payment method “Apple Pay” when making a donation for the purpose of payment processing, your information provided during the payment process, along with the information about your donation, will be transmitted to Apple. - To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Company about our users is among the assets transferred.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
- To enforce our rights arising from any contracts entered into between you and us (e.g, our Terms of Use), including for billing and collection.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Company, our customers, or others. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Retention of Your Personal Information
We will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
To the extent permitted by applicable law, we may also, but are not required to, retain backup information related to your account on our servers for as long as is reasonably necessary after cancellation for fraud detection, Services operation or to comply with applicable law or our internal security policies. Please be aware that, due to the nature of certain internet and mobile technologies outside our control, such as caching and networked technology, your account may not be instantly inaccessible to others, and there may be a delay in the removal of your information and content from elsewhere on the internet and from search engines.
We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.
Your Choices About Our Collection, Use, and Disclosure of Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

If you do not want us to use your contact information to promote our own or third parties’ products or services, you can opt-out by adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to support@giveinapp.com.
As of the effective date, we do not: (1) use information that we collect or that you provide to us to deliver advertisements according to advertisers’ target-audience preferences; or, (2) share your Personal Information with unaffiliated or non-agent third parties for advertising and marketing purposes.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.
Accessing and Correcting Your Personal Information
You can request access to, correct, or delete any Personal Information or User Content by visiting your account profile page.
You may also send us an email at support@giveinapp.com to request access to, correct, or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Content from the Services, copies of your User Content may remain viewable in chached and archived pages, or might have been copied or stored by other Website or App users. Proper access and use of information provided on the Services, including User Content, is governed by our Terms of Use

Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.
Under certain circumstances by law, you may have the right to:
- Request access to your Personal Information. This enables you to receive details of the Personal Information we hold about you and to check that we are processing it lawfully.
- Request correction of the Personal Information we hold about you. You may ask us to correct Personal Information we hold about you if it is inaccurate or incomplete.
- Request erasure of your Personal Information. In some circumstances, such as where we no longer need it or if you withdraw your consent (where applicable), you may ask us to delete or remove your personal data where you have exercised your right to object to processing (see below).
- Request the restriction processing of your Personal Information. You may ask us to suspend the processing of your Personal Information in certain circumstances, such as where you contest the accuracy of the information or object to our use or stated legal basis.
- Object to our processing of your Personal Information. Where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your Personal Information for direct marketing purposes.

As of the effective date, we do not knowingly meet the required thresholds for state privacy laws based on sales, customer, or residency thresholds; however, if you believe you be able to exercise any of the above rights, please contact us using the information below.
You will not usually have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.
We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.
Data Security
We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alternation, and disclosure. All information you provide to us is stored on our secure servers located on a virtual private cloud (VPC) in Amazon’s Relational Database Service (RDS). Any passwords, data at rest in the database, and data sent between the application server and mobile application is encrypted using SSL technology. All payment transaction information is stored in the corresponding payment systems (e.g. Apple, Google).
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
Changes to Our Privacy Policy
We may update our Privacy Policy from time to time at our discretion, likely, but not necessarily, in response to changes in state or federal laws or technology updates. If we make changes to how we treat our users’ Personal Information, we will post the new Privacy Policy on this page and notify you by email to the primary email address specified in your account.
